To qualify for a Food and Beverage certificate, a business must either be defined as a “restaurant” under the law or keep the business’s alcohol sales to 60% or less of its total sales.
A restaurant is defined by:(A) operates its own permanent food service facility with commercial cooking equipment on its premises; and (B) prepares and offers to sell multiple entrees for consumption on or off the premises

Hours: This permit allows you to be open until 2 am every day. You can always take off your Late Hours Certificate if you decide it is not what you need.
Things to keep in mind
Credit does not influence your ability to obtain any permit, however, MB permitees are required to post two $3,750.00 Mixed Beverage Bonds by the Comptroller of Public Accounts after the state alcohol permit is issued. If the applicant's credit is good, our bonding company will only require the applicant to purchase the bonds at a small fraction of the full amount. If the applicant's credit isn't good - the bonding company might not approve the bonds and the applicant will have to make the $3,750.00 deposit per bond directly to the comptroller.
Mixed Beverage Bonds expire every December 31st regardless of when they were obtained.
Deposits to Comptroller can be requested to be released after two years of correctly paying and reporting taxes on time. For Comptroller to decide if reports were done with no errors, they might conduct an audit before releasing the deposit.
Mixed Beverage Permits are the most expensive state permits which is why city and county departments are not allowed to charge for their local permits until the 3rd year of business. The City of Houston is one of the only cities in the state that charges for their city permit every year. State and County permits are due every two years. If your location is outside the city limits, you don't have to worry about city permits.
